App terms of use

Version of 12 October 2026

Article 1. Who I am

Timon Dhaeze Coaching is a trade name of FD96 BV, a private limited company under Belgian law, Vrijdagmarkt 61 box 101, 9000 Ghent, company and VAT number BE 1042.266.978, Register of Legal Entities Ghent. You can reach me at coaching@timondhaeze.com, on +32 478 62 06 56 and through the chat in the app.

Article 2. Scope

2.1 These terms govern the use of the Coach Timon app and its web environment (the "App"). The App is offered by FD96 BV, trading as Timon Dhaeze Coaching.

2.2 What you buy, what it costs, how you cancel and your right of withdrawal are set out in my terms and conditions. If the two texts contradict each other, the terms and conditions prevail.

2.3 By creating an account or using the App, you accept these terms.

2.4 The App is available in a closed beta for a limited group of testers from 1 November 2026. The official launch follows on a date still to be announced.

2.5 Payments in the App are handled by a payment service provider. I never see your card or account details.

Article 3. Access and account

3.1 You get access to the App with a subscription, as a tester in the closed beta or as part of an ongoing coaching programme.

3.2 The App is only intended for clients aged eighteen or over.

3.3 You keep your password secret and share your account with no one. If you suspect misuse, let me know straight away.

3.4 You provide accurate information and update it when it changes. Your training and nutrition plan are built on what you tell me.

Article 4. What the App does

4.1 In the App you find your training plan, your nutrition plan, your habits, your weekly check-in, your progress and the chat with me.

4.2 You can connect the App to Apple Health on iPhone or to Health Connect on Android. You switch this connection on and off yourself in the settings. While it is on, only your steps, your active calories, your sleep, your heart rate and your recorded workouts and activities come in automatically and I can view them to adjust your plan. You choose yourself which of those categories you share.

4.3 The App sends reminders and scheduled follow-up steps automatically according to your programme.

Article 5. Availability and technology

5.1 The App runs on the platform of a specialised software provider that acts as a processor on my behalf. You can find who that is in the legal notice.

5.2 I aim to keep the App available at all times. Maintenance, updates or outages at the provider or on the network can make the App temporarily unavailable. If the App is down, your coaching continues by email or phone.

5.3 You provide a suitable device, a recent version of the App and an internet connection yourself. Connection costs are yours.

Article 6. Health

6.1 Coaching is guidance on training, nutrition, lifestyle and sleep. I am not a doctor. The App does not replace medical advice, diagnosis or treatment.

6.2 Measurements from a watch or a health app are indicative. They are not medical measurements.

6.3 If you feel pain, dizziness or anything else that is not right, stop the exercise and see a doctor. In a medical emergency, call 112.

6.4 If you have a condition or an injury or take medication, tell me before you start and every time something changes.

Article 7. What I expect from you

7.1 You use the App only for your own coaching.

7.2 You do not copy, distribute or sell any programmes, plans, videos or other content from the App.

7.3 You use the chat respectfully and post no content that is unlawful or infringes the rights of others.

Article 8. Intellectual property

8.1 The programmes, plans, texts and questionnaires I wrote for the App are mine or licensed to me. Exercise videos, animations and other material made by others remain the property of their respective owners and are used in the App under licence. You receive a personal right to use all of this while your access to the App runs.

8.2 The App software is the property of the provider.

Article 9. Your data

9.1 I process your data, including your health data, in line with my privacy policy. There you can read which data I process, why, how long I keep it and which rights you have. It also describes which health data the App reads from Apple Health or Health Connect.

9.2 The App provider processes your data only on my behalf and according to my instructions.

Article 10. End of your access

10.1 You can delete your account yourself at any time in the App, via Profile and My account. Your account and your data in the App are then permanently erased after thirty days. Within those thirty days you can still undo the deletion. You can also have your account deleted by emailing coaching@timondhaeze.com. What is deleted and what is kept is set out on the page Delete your account.

10.2 Deleting your account does not end your coaching agreement. Cancelling works according to the terms and conditions.

10.3 When your programme ends, your access to the App ends. If you want to take your data with you, email me.

10.4 If you use the App in breach of these terms, I can suspend your access. I tell you why first, unless the seriousness of the breach makes that impossible.

Article 11. Liability

11.1 My liability is governed by article 19 of my terms and conditions.

11.2 I am not liable for damage caused by an outage at the provider, your device or your internet connection, except in case of intent or gross negligence on my part.

11.3 Nothing in these terms limits the rights the law gives you as a consumer.

Article 12. Changes

If I change these terms, I let you know in advance in the App or by email. The version on this page applies.

Article 13. Complaints and applicable law

13.1 If you have a complaint, email me at coaching@timondhaeze.com. You get a reply within five working days.

13.2 If we cannot resolve it together, you can turn to the Belgian Consumer Ombudsman Service free of charge (consumentenombudsdienst.be).

13.3 Belgian law applies. If you live in another country as a consumer, you keep the protection of the mandatory consumer rules of your country of residence. In case of a dispute, the courts designated by law have jurisdiction.

Article 14. If you download the App through Apple's App Store

14.1 These terms apply between you and me. Apple Inc. is not a party to them. I am responsible for the App, its content, its maintenance and its support, within the limits of these terms. Apple has no obligation whatsoever to provide maintenance or support.

14.2 If the App does not work as these terms describe, you can notify Apple. Apple will then refund the purchase price of the App if you paid for it. To the extent permitted by law, Apple has no other obligation regarding the working of the App.

14.3 For claims about the App, such as a product liability claim, a claim that the App fails to meet a legal or regulatory requirement or a claim under consumer protection or privacy law, I am the point of contact. Apple is not responsible for them.

14.4 If anyone claims that the App or your use of it infringes their intellectual property rights, I am responsible for the investigation, defence, settlement and discharge of that claim. Apple is not.

14.5 You declare that you are not located in a country subject to a United States embargo or designated by the United States as a country supporting terrorism. You also declare that you are not listed on any United States government list of prohibited or restricted parties.

14.6 Apple Inc. and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you as a third-party beneficiary.

Article 15. Founding lifetime access

15.1 Founding lifetime access is a single payment of €199 including VAT. There are 100 places. People on the waiting list can buy it from one week before the official launch and get access to the App from the moment they pay. Places still open are available to everyone from the official launch. The date of the official launch is still to be announced.

15.2 Lifetime means for as long as I offer the App. You get the same App as a regular subscriber, including later updates.

15.3 If I stop offering the App within three years of your payment, I refund €199 pro rata: one thirty-sixth for every full month that remains of those three years.

15.4 Lifetime access is personal. You cannot transfer or resell it.

15.5 Nothing in this article limits your right of withdrawal or your other rights as a consumer.

Article 16. Satisfaction guarantee

16.1 If you have a monthly subscription and you are not satisfied with the App, you can ask for a full refund of your first month within thirty days of your first monthly payment. Your first monthly payment follows the free two-week trial.

16.2 The guarantee applies only to the monthly subscription. It expressly does not apply to the 6-month plan, the 12-month plan and founding lifetime access. Article 15 applies to founding lifetime access.

16.3 You request the refund by e-mail to coaching@timondhaeze.com.

16.4 I refund you within fourteen days of your request, using the same means of payment you paid with. After that your access to the App stops and your subscription ends.

16.5 You can use the guarantee once, also if you take out a new subscription later.

16.6 This guarantee comes on top of your statutory right of withdrawal and your other rights as a consumer. It does not limit those rights.
